Who can marry in Nepal?

According to the Muluki Civil Code 2074,

• If both males and females are single/unmarried/divorced
• If the man and the woman are not punishable by law for incest regarding marriage, except for certain caste people who traditionally accept such practices.
• If both of them can make their own decision.
• If both males and females are above 20 years old.

To get married in Nepal, one must meet the requirements of the Nepalese government to make the marriage legally binding. According to the National Civil Code of Nepal, if a man and a woman accept each other as a couple (husband and wife) through any event, ceremony, formal, or other activity, they will be recognized as husband and wife.

Court marriage can be done in Nepal between Nepali and Nepali, Nepali and Foreigner, and also between Foreigner and Foreigner.

Documents Required for Court Marriage in Nepal For Nepali and Nepali

1.	Citizenship of both partners
2.	Unmarried Certificate/Single Status Certificate of both partners
3.	2 witnesses with original Nepali citizenship
4.	4-4 pp size photos of both partners
5.	Temporary Residence Certificate if you are registering from the temporary district address

Explanation

Both partners must have original citizenship. An unmarried certificate from the ward office of permanent address is necessary for both partners. Similarly, any two witnesses with original citizenship are required. Witnesses may be your friends, relatives, or parents. Witnesses must be present in the court.

Also, if you want to marry in a district court other than the court of your permanent residence, a temporary residence certificate is required. You should stay a minimum of 15 days to do so. For example, if you want to process a court marriage from Kathmandu district court but are from Chitwan district, you should stay in Kathmandu for 15 days and get the temporary stay certificate from the ward where you reside.

3.	Temporary Residence Certificate of both partners ( minimum 15 days stay certificate)
4.	Passport and Visa of Foreign Partner
5.	No Objection Letter (NOC) from the Embassy of the respective country located in Nepal for the foreigners
6.	Marriage law of the respective country for foreigners
7.	4-4 pp size photos of both partners

Explanation

Foreigners must stay in Nepal for 15 days to get married in Nepal, and he/she must obtain a temporary residence certificate. NOC is provided by his/her respective embassy located in Nepal. But make sure to bring the documents required from your country to get an NOC from the embassy.

Also, some countries provide the NOC from their own country. So first, contact your embassy in Nepal before coming to Nepal, ask for the documents you must bring, and book the appointment online. Regarding the Marriage law of your respective country, it is unnecessary to bring that law as it is available in Nepal.

Process of Court Marriage in Nepal

1. After all the required documents are fulfilled, write an application to the court for the court marriage process and submit it to the Marriage Registration Department.
2. After the verification by the Marriage Registration Department and completing legal procedures, you are asked to present in front of the judge, and the judge finally grants the court marriage.
3. Lastly, you can get your marriage certificate from the Marriage Registration Department.
